Ltd.), which will give you access to valuable nonpublic information pertaining to your company or a company for whom you or your employer provides services. Your access to this site/application is made possible through a license agreement between Google Inc. and you (either an individual or a legal entity that you represent as an authorized employee or agent) (You) which is available at http://www.google.com/analytics/tos.html. By accessing or purchasing the Tatvic GA excel plugin you acknowledge that you have read, agree and understood the Tatvic GA excel plugin term of service and Google Analytics Term of Services. You may use Tatvic GA excel plugin to extract data from your Google Analytics account or for the accounts that you have authorized access. Please note that Google Analytics and Microsoft Excel are the trademark of Google, Inc. and Microsoft Inc. and they are not affiliated with Tatvic GA Excel Plug-in. Google, Inc. or Microsoft Inc. accepts no responsibility, liability and does not provide support to individuals choosing to use this product. You must not:

1. Alter, merge, adapt, modify, translate, or create derivative works based on the Tatvic GA Excel plugin
2. Access the Service with any automated software program unless you have been granted permission in written consent from Tatvic Analytics Pvt. Ltd.

You acknowledge and agree that except for the rights expressly granted above, all other rights, title and interest in and to the Service, including any and all patent, trademark, copyright, trade secret, intellectual and industrial property rights remain the sole and exclusive property of Tatvic Analytics Pvt. Ltd. You are not authorized to use the Tatvic GA eExcelplugin name or any of its trademarks in any manner whatsoever, absent prior written approval from Tatvic Analytics Pvt. Ltd.

Data Storage:

Tatvic servers have access to only OAuth tokens i.e. access tokens & refresh tokens from Google analytics. Tatvic servers doesn’t store any google analytics data for their client.

Termination:

If you violate any of these Terms of Use, your permission to use the tool, Applications will automatically terminate.

Applications and Content are PROVIDED AS-IS

THE APPLICATIONS AND CONTENT ARE PROVIDED AS IS, WITHOUT WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, TATVIC ANALYTICS PVT. LTD. EXPLICITLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT OR NON-INFRINGEMENT. TATVIC ANALYTICS PVT. LTD. MAKES NO WARRANTY THAT THE SITE, APPLICATIONS, CONTENT OR ANY PAY-PER-CLICK WEBSITE OR INTERFACE WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. TATVIC ANALYTICS PVT. LTD. MAKES NO WARRANTY REGARDING THE ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS OR RELIABILITY OF ANY DATA OR INFORMATION OBTAINED THROUGH THE SITE, APPLICATIONS, CONTENT, OR FROM ANY PAY-PER-CLICK WEBSITE OR INTERFACE. YOU UNDERSTAND AND AGREE THAT TATVIC ANALYTICS PVT. LTD. IS NOT RESPONSIBLE FOR THE FUNCTIONALITY OF GOOGLE ANALYTICS OR GOOGLE ADWORDS, OR WEB SITE OR INTERFACE.

Right to use logo

The customer agrees to let Tatvic use their organization’s logo in Tatvic’s customer list, marketing material and at other places on its website including but not limited to www.tatvic.com

Indemnity

You agree to defend, indemnify, and hold harmless Tatvic Analytics Pvt. Ltd., its officers, directors, employees and agents, from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal and accounting fees), arising out of your violation of these Terms of Use.

Limitation of Liability

TATVIC ANALYTICS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES RESULTING FROM YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE, APPLICATIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT TATVIC ASSOCIATE HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

Controlling Law and Jurisdiction

These Terms of Use and any action related thereto will be governed by the laws of Govt. of India without regard to its conflict of law provisions. The exclusive jurisdiction and venue of any action arising under these Terms of Use or related thereto will be the state and federal courts located in Gujarat, India, and each of the parties hereto waives any objection to jurisdiction and venue in such courts.

Modification of Terms of Services

Tatvic Analytics Pvt. Ltd reserves the right to update and change the Terms of Service from time to time without notice. Any new features or enhancements to the current Service shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.
